PGS SHORTLET GUSET TERMS AND CONDITIONS
Welcome to PGS SHORTLET’ subscription Portal:.pgservices.ng/shortlet-bookings (‘Portal’). The PGS SHORTLET portal is a provider of several luxury fully furnished terrace houses available for short let.
The Terms and Conditions (‘Terms’) herein is between Preedep Global Services (‘PGS SHORTLET) and a user who accesses or subscribes to the Portal (‘Guest). The Terms stipulates the term and conditions of our relationship with our Guests, as supplemented by our Privacy Policy. By using or subscribing to the Portal, you agree to be bound by the following terms and all applicable laws and regulations. The Terms and Conditions herein govern our guest’s use of our shortlet and access to the Portal.
PGS SHORTLET reserves the right and sole discretion to modify these Terms at any time and it is therefore advised that you(Guest) should from time to time review the most current terms and any relevant specific terms each time you visit the Portal. Your continued use of the outlet after changes are implemented constitutes your acknowledgment and acceptance of the changes.
Your use or access to the Portal in any way signifies your constructive and actual notice and knowledge of and agreement to be bound by, the most current version of the Terms as posted on the Portal and our Privacy Policy. It is solely your responsibility to ensure that your use of any is in compliance with all our requirements.
1. Eligibility to use the Portal
a. In order to use or access the Portal or subscribe/register for our Services, you represent and warrant that you are at least 18 years of age and are legally able to enter into a binding contract.
b. You authorize us, directly or through third parties, to make any inquiries we consider necessary to validate your identity and the authenticity of your information.
2. User Representation
a. You represent, warrant and agree that no materials of any kind submitted or provided through your Account or otherwise posted or shared by you through the Platform will violate or infringe upon the rights of any third party, including copyright, trademark, privacy, publicity or other personal or proprietary rights; or contain libelous, defamatory, fraudulent or otherwise unlawful material.
b. You further agree not to collect email addresses or other contact information of other users from the Portal by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications.
c. Additionally, you agree not to use automated scripts to collect information from the Portal or for any other purpose.
d. You further agree that you may not use the Portal in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Portal.
3. Our apartments
a. Our short let apartments are furnished and equipped to high standards. From time to time, we may change the layout, furniture or fittings and we will try to update these on the Portal at the earliest opportunity and notify Guests if the changes to the properties change the nature of the accommodation.
b. Differences between the description, photos on the Portal and those actually found at the property do not constitute a basis for cancellation, refunds or other claims against us. We will not be liable to Guests in the event of changes made to a property without notifying our Guests.
c. Internet connection is provided in all our Apartments. There is no charge for normal use of this facility. If a loss of internet connection occurs, we will endeavor to get you reconnected as quickly as possible but we cannot be held liable for any losses resulting from the loss of internet connection.
d. Unless otherwise specified, the prices quoted for all serviced Apartments include utilities.
4. Bookings and payments
a. Bookings for accommodation purposes will cost a minimum daily rate as prescribed in your invoice
b. Bookings for get-togethers/hangouts, video shoots, photo shoots or for more than 6 guests / people and not more than 10 guests / people at a time will cost a minimum daily rate as prescribed in your invoice per night.
c. Bookings for Get togethers are prohibited.
d. A booking is not confirmed until you receive a confirmation from us. A pre-payment of 60% of the rental price is payable on booking and confirmation will not be effected until the whole of the payment has been received. The balance of the rental price must be paid 48hrs before check-in and non-payment of the balance by the due date will constitute a basis for cancelling your booking and the application of the cancellation conditions without refund will automatically apply, if cancellation is made outside of cancellation terms stated in this agreement.
e. All bookings are exclusive of VAT and you must pay 7.5% VAT on your daily rates.
5. Cancellation and modification of booking
a. Any cancellation or modification of a booking can only be effected by the Guest providing a written notification of the cancellation or modification to PGS SHORLETS. The non-payment of rental balances results in automatic cancellation.
b. Should the Guest for whatever reason cancel the booking, they will have the right to reimbursement of all money paid subject to the deduction of cancellation charges being 30% of the total rental price if cancellations is made 14 days prior to the guest checking in.
c. Changes to booking dates or Apartments are subject to availability. Each booking change shall incur a service fee of 10% to be paid at the time of confirming the said changes.
d. Cancellations cannot be made once the guest has checked-in and all booking payments are non-refundable after the guest has checked-in.
e. If we cancel a confirmed booking, we shall do our utmost to find a replacement Apartments acceptable to the Guest, or refund any monies paid on unused rental. The Guest agrees and acknowledges that in such event, PGS Shortlet' liability for damages will be limited to the amount of unused rental, based on a pro rata calculation of unused rental days. Should an Apartment becomes unserviceable prior to the arrival of a Guest, We will do our best to find a suitable replacement Apartment of an equal standard. In the event the replacement is a more expensive Apartment, the Guest will have the choice of paying the difference or receiving a full refund of monies paid.
f. The rules for check-in and check-out are set by us. All Apartments are usually available for occupation after 2:00 pm on the day of arrival. All Apartments must be vacated by 11:00 am on the day of departure. If there is any delay in vacating the property beyond the agreed time a full day’s rental is charged to you.
6. Security Deposit and Property Damage
a. A refundable security deposit as prescribed in your invoice shall be required by PGS Shortlet prior to or on arrival of the guest provided the booking is for accommodation purposes only and not get togethers, photo-shoots, video shoots or bookings requiring more than 6 guests/ people and not more than 10 guests / people at a selected PGS Shortlet Apartment per time.
b. Photo-shoots, video shoots or bookings requiring more than 6 guests / people and not more than 10 guests / people at a selected PGS Shortlet Apartment will warrant a ₦ as prescribed in your invoice refundable caution fee and ₦amount as prescribed in your invoice deep cleaning refundable fee payable before check-in at a daily rate of ₦amount as prescribed in your invoice – ₦amount as prescribed in your invoice per night.
c. Photo-shoots, video shoots outside the apartments during bookings would require official permission and a fee of ₦amount as prescribed in your invoice All security deposits are fully refundable provided there are no damages to the booked PGS Shortlet Apartment by guest.
d. In the event that any guest damages an item, multiple items or damage the property, a guest forfeits the deposit paid and the guest is liable to cover cost of up to ₦amount as prescribed in your invoice damages or more equating to the cost of replacing the damaged item(s) or damaged property as stipulated by PGS Shortlet Apartment.
e. The security deposit shall be refunded within 2 working days of the guest’s departure.
f. PGS Shortlet has the authority to withhold or deduct monies from the security deposit or credit card to remedy any damage, excess cleaning, missing items, excess utilities caused by the Guest or to send an invoice for such monies to the Guest by email for immediate payment.
g. A guest may not remove any of the furniture or effects from the Apartment and will be liable for any furniture or effects damaged or missing from the Apartment. Furniture must be returned and restored to its original position.
h. Our representatives have the right of access to the Apartment at any time, with due regard to your convenience, for the purpose of inspection of the Apartment and to carry out any essential repair or maintenance work.
i. Our Security representatives have right of access into the Apartment at any time, regardless your convenience, for the purpose of inspection of the Apartments and executing our emergency and security protocol.
j. Our Security representatives shall conduct random call-ins and check ups to the Apartments booked and any missed call will automatically effect an Emergency and Security protocol.
7. Conduct of Guests
a. All guests must provide proof of identification and proof of registration before check-ins specifically NIN (National Identification Number) and International Passport.
b. Drivers License and other means of identification will not be accept as a valid means of identification/check-ins.
c. False or suspected to be false means of identification will be subjected to automatic eviction of the user without refund and report to the appropriate security authorities.
d. Smoking of cigarettes (E-cigarettes inclusive), marijuana are not allowed inside the apartment/property and if discovered will be subjected to automatic eviction and contract termination of the user without refund with an additional fine of ₦350,000.00 for marijuana, ₦300,000.00 for cigarettes to cover the cleaning of curtains, carpets and replacement of items with burns respectively.
e. All smoking must be done outside the apartment/property.
f. Smoking in apartment/property balconies is prohibited.
g. All accommodation must only be used for private/residential use only. The maximum number of guests allowed is 6.
h. No functions get togethers or gatherings where occupants of neighboring apartments might be disturbed will be conducted at the property under any circumstances unless agreed by PGS Shortlet Apartments in writing before the guest checks in.
i. Exceeding the number of allowed guests will result in automatic termination of booking and you being required to vacate the property immediately without refund unless already agreed in writing by PGS Shortlet Apartments.
j. You must leave our Apartments in a clean and tidy condition. You must also comply with the By-Laws that apply to the Apartments and shall not conduct yourself in such a manner to would constitute nuisance or annoyance to adjoining neighbouring occupiers or the environment. In the event that the Apartment requires deep cleaning as a result of your stay, you will be charged an additional ₦amount as prescribed in your invoice and you will forfeit your deposit.
k. No pets are allowed inside the accommodation under any circumstances. Any pets found inside the Apartment will result in a termination of your booking without refund.
l. Noise making warrants an exclusive fine of ₦amount as prescribed in your invoice
m. We have the right to terminate a booking at any time on the grounds of breaking any clause of the terms or the abuse these terms including being a nuisance to staff, residents or other guests, mistreatment of the Apartment or criminal activity on the part of those occupying the apartment. No refunds are made in the event any of this issue occurs.
8. Suspension of the Portal
We do not guarantee that our Portal will always be available or be uninterrupted. We may suspend or withdraw or restrict the availability of all or any part of our Portal for business and operational reasons.
9. Ethical Apartments
If you are in an Apartment designated as an Ethical one which is defined as an Apartment catering for people of faith based on their values and principles you are not allowed to:
a. Drink alcohol
b. Smoke
c. Do drugs
d. No premarital sex allowed
e. Opposite sex who are not married cannot book together or stay the night unless they are married.
It is instructive to note that the above will not apply in the regular apartments.
Our Apartments can only booked for:
- getaways
- couples break
- Get togethers no more than 10
- photoshoots
- video shoot
- baby shower
- bridal shower
- honeymoon
- engagement proposal
- travellers lodge
- Me time (personal time/ getaway)
- temporaryAccommodation
10. Emergency and Security Protocol
a. Where it is discovered that the user has deliberately breached any provisions of this agreement, this shall give our Security representatives the automatic right of access into the property at any time to ensure order and safety.
b. All matters regarding any form of damage to the Apartment, threat to life or any fundamental right violation from the conduct of the user, will result to the report and intervention of the Nigerian Police through our security representatives and the payment for such damage where fit.
c. For ensuring safety and order, our Security representatives have an automatic right of access into the Apartment at any time with the right to perform random checks and inspections during the user’s stay.
11. Loss of Revenue
Any loss of revenue or depreciation in property value caused by an act, omission or default of the user, making the Apartment unrentable or not tenantable after usage will result in the intervention of necessary authorities to make arrests, eviction without refund, presentation of collateral or payment of repair and total coverage of the projected revenue cost for the next 12 months by the user for the said Apartment.
12. Disclaimers
PGS Shortlet do not promise that the Portal or any content, service or feature of the Portal will be error-free or uninterrupted, or that any defects will be corrected, or that your use of the Portal will provide specific results. The Portal and its content are delivered on an "as-is" and "as-available" basis. All information provided on the Portal is subject to change without notice. We cannot ensure that files or other data downloaded from the Portal will be free of bugs or viruses. We disclaim all warranties, express or implied, including any warranties of accuracy, non-infringement, merchantability and fitness for a particular purpose. We disclaim any and all liability for the acts, omissions and conduct of any third party in connection with or related to your use of the Portal. You assume total responsibility for your use of the Portal.
13. Limitation of Liability
a. Under no circumstances shall PGS Shortlet be liable to you for any indirect, consequential, exemplary, incidental or punitive loss or damages arising from your direct or indirect use of the Portal.
b. Guests acknowledge that they are responsible for taking all necessary safety precautions for themselves and their guests and PGS Shortlet will not in any form bear liability for accidents causing death, sickness or bodily harm howsoever caused. PGS Shortlet cannotbear any form of liability or claims in the event of incidents occurring whilst occupants or guests are under the influence of alcohol or drugs. The limitation of liability for any claim against us is limited to the total amount of rental paid to us by the Guest.
c. We will not be liable for any delay, loss, damage or expenses incurred if your booking needs to be altered or cancelled or we are unable to perform our contractual obligations as a result of events beyond our reasonable control, which shall include but not be limited to events such as war, civil strife, terrorist activity, labour disputes, natural or man-made disaster, fire, flood, and adverse weather conditions
14. Waiver and Severability
a. No waiver of any of the terms and conditions of this Agreement will be binding for any purpose unless expressed in writing and signed by the Party giving the same, and any such waiver will be effective only in the specific instance and for the purpose given. No failure or delay on the part of a party in exercising any right, power or privilege will operate as a waiver, nor will any single or partial exercise of any right, power or privilege preclude any other or further exercise thereof or the exercise of any other right, power or privilege.
b. If any provision of these terms shall be unlawful, void, or for any reason, unenforceable, then that provision shall be deemed severable from this terms and shall not affect the validity and enforceability of any other provisions.
15. Governing Law
All matters or disputes relating to your access to or use of the Portal, or arising from the booking of accommodation with us, will be governed by the laws of The Federal Republic of Nigeria and the Nigerian Courts shall have exclusive jurisdiction to determine such disputes or matters.
